Thirsty Cowboy LLC ("Thirsty Cowboy," "we," "us") is a skincare and lip care brand based in Brooklyn, New York. We operate thirstycowboyskincare.com and our related emails, text messages, and social media pages (the "Services"). Our online store is powered by Shopify.

This Privacy Policy explains what personal information we collect, how we use and share it, and the choices you have. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to personal information.

Personal Information We Collect

"Personal information" means information that identifies, or can reasonably be linked to, you. Depending on how you use the Services, we collect:

Contact details: name, billing and shipping address, email address, and phone number.
Order information: what you view, add to your cart, buy, return, or exchange, and your order history.
Payment information: payments are processed by Shopify Payments (including Apple Pay) and PayPal. We receive transaction details such as the payment method type and confirmation, but we do not see or store your full card number.
Account information: your login, preferences, and settings if you create an account.
Communications: messages you send us, including customer service emails and text replies.
Reviews, quizzes and surveys: reviews, ratings, photos, and survey or quiz answers you choose to submit (see "Reviews, Quizzes and Surveys" below).
Device and usage information: IP address, browser and device type, pages viewed, links clicked, and how you arrived at our site, collected through cookies, pixels, and similar technologies.

Sources. We collect this information directly from you; automatically when you use the Services; from service providers who operate parts of the Services for us; and from advertising and social media platforms (for example, when you interact with our ads).

How We Use Your Personal Information

To run the store: process payments, fulfill and ship orders, handle returns and exchanges, manage your account, and provide customer service.
To improve our products and site: understand what customers like, fix problems, and develop new products.
Marketing: send emails and, if you opt in, text messages about products and promotions, and show you ads on other websites and social media based on your activity on our site.
Security and fraud prevention: protect our customers, our store, and our payment systems.
Legal reasons: comply with the law, respond to legal requests, enforce our terms, and defend legal claims.

Cookies, Pixels and Advertising Tools

We and our partners use cookies, pixels, and similar technologies to operate the store, remember your cart, measure how our site and ads perform, and show you relevant ads. The tools we use are:

Shopify: hosts the store, checkout, and Shopify analytics
Klaviyo: email and text message marketing, sign-up forms, and product reviews
Meta (Facebook and Instagram): advertising and ad measurement
TikTok: advertising and ad measurement
Google: advertising, ad measurement, and site analytics
Pinterest: advertising and ad measurement
Moast: shows shoppable videos from our Instagram, TikTok, and customers on our site, and measures how shoppers interact with them

These advertising partners may collect information about your visit, such as pages viewed and products purchased, and use it under their own privacy policies. Under some state laws, this may count as "selling" or "sharing" personal information for targeted advertising.

Your choices. Where required by law, our cookie banner asks for your consent before non-essential cookies and pixels run. You can change your choice at any time with "Manage preferences" or by visiting Your Privacy Choices. You can also limit ad tracking through your browser or device settings.

Text Messages and Email

Text messages. If you opt in to texts from Thirsty Cowboy, we will send recurring automated marketing and order-related text messages to the mobile number you provide, using our messaging provider, Klaviyo. Consent to receive texts is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help. We do not sell or share your mobile number or your text opt-in consent with third parties for their own marketing.

Email. If you sign up or place an order, we may send you marketing emails through Klaviyo. You can unsubscribe at any time using the link in any email. We will still send emails about your orders and account.

Reviews, Quizzes and Surveys

Reviews you submit, including your first name or display name, rating, text, and any photos, may be published on our site and in our marketing. We may ask you to review a product after you buy it, and we publish reviews whether they are positive or negative. From time to time we have offered customers a discount for leaving a review. That discount was never conditioned on the review being positive, and we publish those reviews the same way as all others.

We do not ask for information about skin conditions or other health information through our site, emails, or texts. Please don't send us medical information you don't want us to have.

Service providers who run parts of our business for us, under contracts that limit their use of your information: Shopify (store hosting and checkout), payment processors (Shopify Payments, including Apple Pay, and PayPal), Klaviyo (email, text messages, and reviews), our fulfillment partner (ShipMonk) and shipping carriers (to pack and deliver orders), and our accounting, tax, and customer service tools.
Advertising partners listed in the Cookies section above, to show and measure ads. You can opt out of this at Your Privacy Choices.
When you direct us to, for example when you share a product to social media.
For legal reasons and business transfers: to comply with the law or legal process, to protect our rights and our customers, or as part of a merger, acquisition, financing, or sale of our business.

We do not sell your personal information for money.

Shopify, Other Websites and Children

Shopify. Our store is hosted by Shopify, which processes personal information to provide and improve its services. Shopify also uses some information about your interactions with our store and other merchants to provide certain features, and is responsible for that processing. Other websites. Our site may link to other websites and social media platforms. Their own privacy policies apply, and we are not responsible for their practices.

Children. The Services are not directed to children under 16, and we do not knowingly collect personal information from them. We do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.

Security, Retention and Your Rights

Security. We use reasonable safeguards, and we rely on service providers with their own security programs, to protect your information. No system is perfectly secure, so please don't send us sensitive information by email or text.

Retention. We keep personal information as long as we need it to provide the Services, maintain your account, keep business and tax records, resolve disputes, and comply with the law.

Your rights. Depending on where you live, you may have the right to:

Access or receive a copy of your personal information
Correct inaccurate information
Delete your personal information
Opt out of the "sale" or "sharing" of your information for targeted advertising
Appeal a decision we make about your request

To opt out of targeted advertising, visit Your Privacy Choices. If your browser sends a Global Privacy Control signal, we treat it as an opt-out request for that browser where required by law. We do not respond to other "Do Not Track" signals.

To make any other request, email us at the address below. We may need to verify your identity first, and you may use an authorized agent with proof of authorization. We will not discriminate against you for exercising your rights.

International Visitors, Changes and Contact

International visitors. We are based in the United States, and your information is processed here and in other countries where our service providers operate. For transfers from the EEA or UK, we rely on recognized transfer mechanisms such as Standard Contractual Clauses.

Changes. We may update this policy from time to time. We will post the new version here and update the "Last updated" date.
